This action was commenced by Allstate Insurance Company against Truck Insurance Exchange for indemnification in the amount
of $18,000 paid by Allstate in discharge of an alleged obligation of Truck Insurance Exchange. The claim arises out of a shooting
accident on a hunting trip in Wyoming resulting in the death of Vincent V. Jaskowiak, owner and driver of a 1963 Chevrolet
panel truck insured by Truck under a comprehensive automobile liability insurance contract. The passenger, Eugene A. Macsurak,
who was holding a rifle at the time of the fatal shot, was insured under a comprehensive liability policy issued by Allstate
and identified as a "Homeowners Policy." Both men were residents of Milwaukee, Wisconsin. It is conceded the settlement was reasonable and that both policies of insurance were in full force and effect at the time
of the accident. There is no issue as to permission to use the vehicle and no significant dispute as to the facts.
